Terms of Service

These Terms of Service (the "Terms") govern your access to and use of pixelto.com and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms, our Privacy Policy, and our Content Policy.

1. Eligibility

The Service is for users who are at least 18 years old and able to enter into a binding agreement. If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Accounts and Access Security

You must provide accurate account information, keep your credentials secure, and are responsible for activity under your account. Promptly contact [email protected] if you believe your account has been accessed without authorization.

We may restrict, suspend, or terminate access when we identify a security risk, abuse, fraud, or a violation of these Terms or the Content Policy.

3. Service and Models

The Service uses official, third-party, and open-community models and infrastructure. Model and provider capabilities, limitations, availability, and safety controls may vary. To protect safety, compliance, operations, or service integrity, we may change, limit, disable, or replace a model, provider, or feature.

4. Your Content and Required Rights

"Input" means prompts, reference images, and other materials you submit to the Service. "Output" means results generated or edited by the Service from Input.

You retain any rights you have in your Input and represent that you have all rights, licenses, permissions, and consents needed to submit it, including for another person's likeness, personal information, intellectual property, or other protected material.

You are solely responsible for your Input, Output, and any use, publication, or distribution of either. You grant Pixelto a limited, non-exclusive license to process and transmit your Input only as necessary to provide the Service, protect the Service, and enforce these Terms. Pixelto does not use your prompts, reference images, or Output to train AI models, improve products, publicly display content, or market the Service.

5. Output and Your Use of It

AI Output may be inaccurate, incomplete, unsuitable for a particular purpose, or similar to existing works or Output received by other users. You must independently review Output for accuracy, suitability, legality, and third-party rights before using, sharing, or publishing it.

Subject to these Terms, the Content Policy, applicable law, and any model or feature restrictions stated in the Service, Pixelto does not claim ownership of your Output, and you may use Output for lawful personal or commercial purposes. Pixelto does not guarantee that Output is unique, available, copyrightable, commercially usable, or non-infringing.

6. User Content Is Not Pixelto Content

Input and Output are submitted, requested, selected, or used by you. They do not represent Pixelto's views, position, endorsement, recommendation, or guarantee. Except where required by applicable law, we have no duty to proactively review, monitor, or verify all Input or Output before it is generated, used, or published.

Any action, inaction, or failure to act by Pixelto in reviewing, restricting, removing, or otherwise enforcing against content does not constitute approval, permission, a guarantee, or a commitment concerning that content. It also does not relieve you of responsibility for the content or its subsequent use.

7. Acceptable Use

You may not use the Service to:

  1. Violate applicable law, regulation, or another person's rights.
  2. Generate, edit, distribute, or facilitate unlawful, exploitative, sexually explicit, or harmful content.
  3. Circumvent safety controls, abuse Service limits, interfere with system integrity, or attempt unauthorized access to accounts, systems, or data.
  4. Use Input or Output in a way that violates the Content Policy.

8. Fees, Subscriptions, and Credits

The price, billing period, automatic renewal status, entitlements, and rules shown at checkout control a purchase. Descriptions on pricing and product pages are not a guarantee of future plans, prices, models, or availability.

  1. Subscription credits are granted each billing cycle. Unused subscription credits expire at the end of that cycle and do not roll over. Annual plans are billed annually, but credits are granted and used on a monthly cadence.
  2. One-time credit top-ups are available only to active paid subscribers. Unless checkout states otherwise, top-up credits expire one year after they are granted. Credits are Service usage units, have no cash value, and may not be transferred, sold, redeemed for cash, or exchanged for a cash payment.
  3. A subscription identified as automatically renewing renews at the end of the current billing period unless you cancel it through an available billing-management method before renewal. After cancellation, purchased entitlements ordinarily remain available through the end of the current billing period.
  4. We may change future plans, prices, credit rules, or feature scope, but will not retroactively change the price or core entitlements of a completed purchase during its current billing period. The price and terms for a future purchase or renewal will be shown at checkout.
  5. Except where required by applicable law, where the Service has a material failure to provide what was purchased, or where stated at purchase, subscription fees and one-time credit purchases are non-refundable. These Terms do not exclude any mandatory withdrawal, refund, or consumer-protection right.

9. Pixelto Intellectual Property

The Service's software, interfaces, design assets, trademarks, and related materials are owned by Pixelto or its licensors. Except as these Terms expressly allow, you may not copy, modify, reverse engineer, distribute, or create derivative works from the Service.

10. Third-Party Services

The Service depends on third-party infrastructure, payment services, and model providers. To the maximum extent permitted by applicable law, Pixelto is not responsible for a third party's interruption, failure, policy change, or conduct.

11. Suspension and Termination

To protect users, the Service, security, or legal compliance, or to enforce these Terms and the Content Policy, we may restrict, suspend, or terminate your access. Your right to use the Service ends when access is terminated.

If we restrict, suspend, or terminate access because you violated these Terms, the Content Policy, or applicable law, we are not required to refund fees or restore expired credits except where applicable law requires otherwise.

12. Indemnification

To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless Pixelto and its service providers from third-party claims, losses, liabilities, fines, costs, and reasonable legal fees arising from your Input, Output, account activity, violation of these Terms or the Content Policy, or infringement of another person's intellectual property, privacy, likeness, personality, or other rights. We will notify you where reasonably practicable and may control the defense and settlement of a claim.

13. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, completely secure, or suitable for your particular purpose.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Pixelto is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from or related to the Service.

To the maximum extent permitted by applicable law, Pixelto's total liability for all claims arising from or relating to the Service will not exceed the greater of: (a) the fees you actually paid to Pixelto in the 12 months before the event giving rise to liability; or (b) US$100 or its local-currency equivalent. This limitation does not limit liability, consumer rights, or remedies that cannot lawfully be excluded or limited.

Except for Pixelto and its service providers expressly protected by these Terms, these Terms do not grant any third party an enforceable right or remedy.

15. Changes and Contact

We may update these Terms from time to time and will update the "Last updated" date on this page. Continued use of the Service after an update means you accept the updated Terms to the extent permitted by applicable law.
